Presumption tiers in the final rule

Tier	Typical contents
Current status	In custody or under supervision; fugitive; unlawful user; certain aliens; active DV order
Permanent (absent extraordinary circumstances)	Homicide, sex offenses, trafficking, robbery, carjacking, kidnapping, terrorism, many violent felonies
10-year	Drug trafficking, MCDV, threats, some explosives/firearms offenses, animal abuse, some school-grounds weapons cases
5-year	Most other felonies and specified misdemeanors, measured from completion of all sentence components

A presumption is not an absolute bar, but “extraordinary circumstances” is a high bar. We do not market around it.

State law is a second lock

Winning federal relief does not let you possess a firearm in a state that still forbids it. Some states restore rights automatically after a waiting period. Others require a pardon, expungement, or a separate petition. We flag the state question in every intake.
